Brock Hatherton Limited (registered in England and Wales, company number 17228179, registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ) takes the privacy of its website visitors and clients seriously. This policy explains what personal information we collect, why we collect it, how we use it, and the rights you have over it.

This policy is written in plain English. If anything is unclear, please contact us at seb@brockhatherton.com.

Who we are

Brock Hatherton Limited ("we," "us," "our") is the data controller for personal information collected through this website and through our advisory work. Our website is brockhatherton.com.

What information we collect

We collect personal information from you in the following circumstances:

When you contact us via our website. Our contact form collects your name, email address, and (optionally) your phone number and a short message describing your enquiry.

When you contact us by email or phone directly. We retain the contents of our correspondence with you.

When you engage us for advisory work. We collect such information as is reasonably necessary to provide our services, which may include your address,

financial information relevant to your project, details of the property or land in question, and other information you share in the course of our work together.

Through routine website operation. Our website provider (Wix) collects standard technical information including IP address, browser type, and pages visited, used to operate and improve the site. This data is anonymised where possible and is governed by Wix's own privacy policy.

We do not collect special category data (such as information about your health, ethnicity, religion, or political views) unless you voluntarily provide it in correspondence with us.

How we use your information

We use your personal information for the following purposes:

To respond to your enquiry. When you contact us, we use the information you provide to reply, arrange a conversation, and (if relevant) explore whether engagement is appropriate.

To provide advisory services. Where you become a client, we use your information to deliver the services we have agreed.

To comply with legal and regulatory obligations. This includes obligations relating to our records, our regulatory status, and applicable money laundering and professional conduct requirements.

To send you occasional communications. If you have engaged with us, we may from time to time send you information we believe will be of professional interest. You can opt out of this at any time.

We do not use your information for automated decision-making or profiling. We do not sell your personal information to third parties.

The legal basis for our processing

We rely on the following legal bases for processing your personal data, depending on the context:

Legitimate interests. Where we use your information to respond to your enquiry, to deliver our services, or to administer our business, we rely on our legitimate interests in operating our business and providing the services you have asked us to provide.

Contractual necessity. Where we have entered into an engagement letter or other agreement with you, we use your information to deliver the obligations of that agreement.

Legal obligation. Where we are required to retain or process information to comply with a legal or regulatory requirement, we rely on that obligation.

Consent. Where we send you marketing communications, we rely on your consent, which you may withdraw at any time.

Who we share your information with

We share your information only where necessary and only with parties bound by appropriate obligations of confidentiality. Specifically:

Our service providers. We use Google Workspace for email and Wix for our website. These providers process data on our behalf and are bound by their own privacy obligations.

Professional advisors and regulated firms. Where the services you require fall outside our consultancy work (for example, reserved legal services or specialist tax advice), we may refer you to regulated firms. We will not share your information with them without your knowledge.

Where required by law. We may disclose your information where we are required to do so by law, regulation, court order, or to comply with our professional obligations.

We do not transfer your personal data outside the United Kingdom or European Economic Area without appropriate safeguards in place.

How long we keep your information

We retain personal information for as long as necessary for the purposes for which it was collected, and thereafter for such period as is reasonable to satisfy our legal, regulatory, and professional obligations. In general:

Enquiry correspondence that does not lead to an engagement is retained for up to 24 months.

Client files and correspondence are retained for a minimum of seven years from the conclusion of the engagement, in line with professional record-keeping requirements.

Website analytics data is retained for the period determined by our website provider's standard settings.

Your rights

Under UK data protection law, you have the right to:

  • Access the personal information we hold about you

  • Request that we correct inaccurate information

  • Request that we delete your information (subject to our legal and professional retention obligations)

  • Object to or restrict our processing in certain circumstances

  • Withdraw consent where we are relying on consent as the legal basis

  • Lodge a complaint with the Information Commissioner's Office (ico.org.uk)

To exercise any of these rights, please contact us at seb@brockhatherton.com. We will respond within one month.

Cookies

Our website uses essential cookies necessary for it to function, and (depending on your consent) cookies for website analytics. You can manage your cookie preferences through your browser settings. For full details, see the cookie information provided by our website provider.

Security

We take appropriate technical and organisational measures to protect your personal information against unauthorised access, loss, or disclosure. No system is entirely secure, but we treat the protection of client information with the same seriousness expected of a solicitor-led practice.
